And it's a service organization, and it has a five-point program of education development, physical and mental health, economic development, political awareness and involvement, international awareness and involvement. The gentleman is recognized to debate the resolution. First of all thank you, Mr. Speaker, for assigning the task of preparing this resolutions to honor our veterans. It's been an honor over the last almost five years to pass many bills to become law but sponsoring this resolution is certainly one of the highest honors. As many of you know, in my early career I worked for congress, and my basic job task was to work for veterans, and I had an honor to meet the numerous men and women who served. And some didn't just merely serve they actually survive death marches or possibly even torture in the Hanoway Hilton. As many came to the office for assistance we started realizing all of these veterans couldn't be fabricating the problems that they had. In fact it was to be well know that many of their records were destroyed in a fire at the national personnel record center. And of course it's not easy to duplicate and bring together the facts of a persons career, and possibly even their injuries which we reconstruct all of the records and medical records. And as many of you know its important if someone has a service connected disability as they receive extra care and services. For instance a POW very well will get free dental care for the rest of his/her live. So knowing all of these we must continue to pay attention to our veterans and their needs. Most of the benefits are at the federal level. However Mr. Speaker we do play a vital role with veteran service officers, state cemeteries and state veterans homes. Also Mr. Speaker it's in order to mention the hardship on the families and as a personal note I can tell you when my brother-in-law was deployed to Iraq, most everyone who had a basic knowledge of Iraq knew that weapons of mass destruction had been used against the [xx] and so my sister and niece and nephew were very concerned when he was deployed to Iraq because they didn't know in what condition he would come home. So as I close Mr. Speaker, I just wanted to say as we move to make our State the most veteran and military friendly State in the nation, we can't forget our veterans or their families. I commend the resolution to the body. Members, there were a number of veterans with us watching I think most have gone over to the Senate. Without objection, the Chair may disperse the bill. I think probably a lot of other members would prefer to have the veterans here observing during this resolution. A bill to be entitled an Act to Authorize the Expansion of Board of Trustees Buffalo county, community college to revive the Buffalo county community college shall serve all of Washington county general assembly of north Carolina enact To what purpose does the gentleman from Dare Representative Tine rise? To debate the bill. The gentleman has the floor to debate the bill. Thank you, Mr. Speaker. This is a local bill about Washington County. For those of you that are not familiar with Washington County. It has one of the highest unemployment rates in the state. It also has unfortunately some of the worst scores on the K through 12 in regards to it is number one in teacher turnover in the state. So it have a lot of statistical issues inside of it's K through 12 even though they are improving and so about a year and a half ago I went to the community colleges, and I asked, why do we not have a community college president there to help with both our K through 12 and with our workforce development, and they said basically because we're dual served, we can't get the critical mass for any one community college to be able to establish a true satellite system there. So by that I
mean with the dual services, Martin Community College has the adult services, Beauford Community College has the K through 12. What I then found out was this is a debate that's been going on for the last 15 years. So I approached both community colleges, and I approached Washington County and asked how they would like to resolve it, they approached both community colleges, both community colleges arrived and said we have the plan we were ready to go, we would love to be involved, we would like to work with you to establish a satellite. There's an existing building that they'd like to occupy and they said we would deliver to you at least what you're getting right now and we'll start to work to expand services. Unfortunately Martin Community College did not show to the meeting with the county they missed the first meeting due to the ice and snow, two subsequent meetings apparently due to illness but didn't send anybody else and then did not respond to an offer to meet by telephone. Unfortunately this reinforce perception within the county that they will not be served they way they wanted to by Martin Community College, for example the emergency services are actually being taught at both community college they have to travel there because Martin College is not providing services as they were supposed to be. The Martin Community College also declined to teach the classes at the North East region of School of Biotechnology in agri-business but for community college again stepped in for this one. Unfortunately, Morton County actually asked for 50% of the FTEs even though they weren't actually providing the classes. Two years the chamber did a poll of their members, 68.2% this is the local chamber said they want one community college 71% said say buffer community college and 28% said Modern community college, so Washington county gave unanimous resolution asking that only one community college service them in a B buffer community college. This bill is not about Mordern community college or Buffer community college. This bill is about Washington County and their need for a single strong proactive partner in Washington county I urdge your support of the bill. For what purpose does the gentlemen from Arshcken Representative Wilingharm rise? Speak on the bill. The gentleman has the floor to debate the bill. Is kind of difficult to respond to representative Tem just told you that I just told you but I can say to you that probably the statistics that I gave you about Washington County you can take those some statistics and they will apply to modern county so I agree with on that but the other things he said is just not accurate. First thing is that I represent Martin County, and I have had no knowledge that this local bill that was introduced until it was over. It was introduced, and I found out about it right before a committee meeting. So I had no knowledge of that. Also the Martin County Community College people said that they had no knowledge of what was going on either. So what has happened here there is a [xx] assigned to the two colleges. Martin County had half of Washington County and Beauford County had half. Well what Beauford County is asking for is to take that half that Martin County has to themselves. As I understand it Beauford College has about 2, 000 students Martin County has about 1000. Martin County as I said before is one of the poorest county in the state unemployment is high for take those [xx] away from Morton County. What will be the effect of that? Well, what you have is a loss of teaching positions, you have a loss of programs that's being presented in that college and you have a lose of students. So what we're going on this, we are giving, we're taking from one to get to another, taking from those who don't have to give to those who do have and and suspect of the [xx] that the chamber is the one who had the emphasis to look at the cam and say, we need to have one college represent us, because the committee college is the one who decided, the service area, not the chamber. So I hope that but there are two or three other situations like that mistake. This figure. So, I would does the gentleman from Mecklenburg Representative Jeter rise? See if the gentleman [xx] for
a quick question Does the gentleman from Edge can be owe to the gentleman from Mecklenburg? Yes He owes It seems like to me this is a Washington County bill, do represent Washington County? No I don't represent Washington County but it's a bill affects martin [xx] because if it's local then it affects those people who are involved. Martin [xx] takes care of half of Washington county since I do represent those people who attend Manhattan county community college, and as I was saying as the legislatures, I don't know if we have the right or to take away from people and get to others at our will and I think is his work where it seems to be happening in this case because the effect on Modern community college will be devastating and and I think if Martin College community college didn't get this have, I don't think they would have any effect on them I think they will be fine, but were not Martin college is not be fine and so if you pass this bill the way it is, what you have is a you're destroying community college. So I would hope that you will be very serious about this because this could happen to your school. Those of you who have community colleges that have service areas and other counties, this could possibly happen to you. So I would ask you to please think about that before you vote for this bill and one of thing we should do is to make the senate to set a committee or something let them see what they are affecting, what can we do if that had to happen. What could we do to Marin County continue to survive but I think this is a bad bill in way it's being presented, so I ask you not to support it thank you. For what purpose does the gentleman from [xx] representative Grey arrives to see if representative time would yield for possibly several questions. Does the gentleman [xx] Absolutely thank you Mr. Speaker thank you representative, so there are clearly are local components to this but I also think there appears to be a state board component, and I went on the committees and I'm just asking was just asking Representative Vinsco[sp?] as well. First question, has the state board taken a position one way or the other? No the state board is not taking the position they were consulted in regards to the language of the bill to make sure that we did things properly on the way through. Second question Mr. Speaker. does the gentleman yield to additional question? Absolutely yields thank you Mr. Speaker, thank you Representative, in the consultation with the board and the president, what is what have they said informally and I recognize they haven't taken formally about their view of the substance, and as important apparently the process of this happening. So it wasn't with the board and the president, it was with their staff in regards to making sure that we drafted in the appropriate manner. I don't know that I feel comfortable since they didn't take official position in regards to what they said privately to myself on the way there, I'd be happy for you to ask him and for them to publicly respond to that, but I don't know that I feel comfortable with that I will say that the official position is consistent, which is no position, was consistent with our interactions that we had. Thank you Mr. Speaker ladies and gentlemen of the house the problem that I have with this bill is that I, it's my responsibility as an elected official to make sure that our community college system is healthy, and that counties that our students in all the counties have access to a community college. I don't know what will happen to the modern community college and I don't know as a result of that whether those that population will be served. I would like to see this made into a study bill. I don't really oppose the initial outcome, what I want to know is how a week is going to take care of citizens that live in [xx] by the modern community college, so that will be my recommendation that's some how we make this a steady bill come back in January make a decision then. For what purpose does the gentleman from Dale[sp?] Representative Tyrone rise? To debate to bill a second time. Gentleman has the floor to debate the bill a second time. Thank you sir, in response to a couple of things that have been said already, I am looking at an email where I did inform the representatives and I should have done it before I dropped the bill.
There is no doubt about that and for that I publicly apologize to you for not contacting you before hand. But long before the bill was heard in committee yesterday, I have an email and I'm looking at it right here, that was on 1st April, that said I apologize for not talking to you before I dropped the bill but I'm happy to talk with you about it further. So just to clear that up since it was presented that you didn't know about it and I didn't let you know. I have the email and I'm willing to share it with anybody that would like to see as far as the health of marketing community college. If they were providing all the services that they have been asked to provide, to Washington County previously and they were in need of funds and they were having a hard time to continue to move forward I will be concerned as well because all this in North Carolina is going to rise together for funding up. The problem is this $2.5 million of the last two years, that they did use and send it back to the state, so it certainly seems that they have economical worthwhile to be able to sustain this change. So, I would be concerned as well but again this is not about marketing community college. They are not in a habit if they have any money left so they will go ahead and try to spend everything just because they say we spend it, there was no complains their cheque will be Community College to see if there were any complaints about the services that were being provided in Washington county, they were none I had no idea so this came out of the blue, nobody knew anything. So I'm just saying to you that again I feel real I'm passionate about this I believe that when you do this to a county that's in this situation that Marin County is I think you are really doing a disservice. so I implore you deep deep really deep think about which you are doing and we can delay this I mean I to agree that if this was sent then let him study it and if he comes back to say that the best thing is that Washington county goes completely both for it I would not have any problem with that. But this is something that some other people who are not in the education with totals and came up with, now if he come to me and say that a study was done and it showed impractically that Washington county would better of with both then I would be finding this I'd be supporting it but that's not the case. State has come to the floor of house of representatives, when it should have been resolved by the State Board and it should have been resolved by the President of the Community College and I know sometimes they don't want to take and no one wants to take positions between colleges and counties but you know that's what they are appointed and elected to do, and I think this is an example that we're being forced to make a decision that should have been made other places and they aggregated their responsibility and pondered it here and I hope that does never happen again. I want to stand at the day and say a word about an interesting event that happened in my district a week ago, a young man's remains came home from Vietnam and 45 years and there was a story in the Gestonio gazette and the Charlotte Observer you may have seen it on the news but this young man's name was Bungent[sp?] Price Junior they called him Junior drafted into the army in 1969 went to Vietnam was on a helicopter that was shot down and then according to the people that are still here it took 45 years for the army needs to find his remains and get him returned to his family off course for that time his parents were gone but his brothers and sisters were still here and they had a very nice ceremony in Gestonio last week and such were honoring friends, I think this man's name needed to be mentioned, and we needed to thank him for his service and if there is something else we can do I'd be glad to do that, but it's not over till everybody is accounted for, and for 45 years, his family all they knew was that he was a PO [xx] wouldn't that be a tough thing to live with? But they finally got some closure, and now he was buried in a grave with two other soldiers that were killed because the [xx] attacked the helicopter after it went down. hTey all survived but apparently they had a skirmish, there was a grave with three soldiers, three American soldiers and they were all finally identified and now, later this year I understand their remains are going to be transferred to Lincoln Cemetery, so it's a a tough ending, it's a sad story, but the family finally got some closure on it and he needed to be mentioned, thank you. My concern here is not that we are providing loans for infrastructure to Municipalities and rural areas, that's fine. My concern is that we're getting into the real estate business again. as a state government, I do not think that we should be extending our self continuously into additional programs that are going to create obligation for us a state in light of what we're looking at with certain budget limitations coming up. Now it's one thing to provide for sewer utility lines, it's another thing to build a building for a locality or to provide the means and the [xx]. I think eliminating the building provision will ensure that localities are serious about these developments that they will have a little extra skin in the game but being responsible for their own buildings, [xx] did a significant incentive program, we've done [xx] we have got some other things on the books currently still coming our way of incentives and other devices to encourage rural development, how far are we going to go, how much do we have to as a state and I'm afraid that we are going create some dependency on local rural area to the state instead of them looking, maybe to do more than themselves and try to get them self to where they need to be, so again this is not eliminating what I consider to be genuine infrastructure of the sewer line, power lines road signage things like that it's simply getting the state out of the real estate business, thank you for what purpose does lady from Wilson representative [xx]. Thank you Mr speaker, we had a very similar amendment come through [xx] committee, which we voted down and I would urge the members to reject this amendments a lot of what we do is infrastructure portion and a [xx] ready side but many of our community have advantage of the self building and both Wilson on state county and Wilson particular have very effectively utilize it's fund but say that not every community has the resources to do it, again this is loan that if money is appropriated into program which will depend on our the budget, so this will be policy in place if there is money in budget goes toward it, so it's not a commitment and its a loan to our local communities. It's kind of a shell building it's not all outfit and all of that staff, but many of the companies who are looking to locate are wanting to know how quckly they can get up and running and this would pretty much cut the deal so I

Ladies and gentlemen of the house I echo what representative Wilson said basically because you are tying the hands if yo disallow these folks to apply for loans from commerce, you're tying their hands, alow these folks that come into these counties, especially rural counties or small when representative [xx] made a comment about, we have [xx] funds available sure we did but those JD funds used to go to larger employers, we need to be have this things ready in this rural areas, till one till two and even in 2 or 3 counties known as the press area. So I would urge you to vote against this amendment. For what purpose does the gentlemen from Klevin [xx] speak on the bill, the gentleman has afforded to make the amendment, if this pretty much gets the bill then I'm [xx] I'm just being honest with you. I think if we're going to spend money and we're going to help them let's help them get the infrastructure and everything but putting up the building, come on, to say that they can't afford to do a [xx] and everything else they should bill to put up the shell building if that's what they need or at least if the infrastructure is in place to get some companies to look at it and say here is the infrastructure everything is done you just need to put up your little building there and we can move forward so I think it's a good amendment and I think it's a good compromise. For what purpose does the gentleman from Waik representative Stem rise? To speak on the amendment. The gentleman has afforded to make the amendment. Mr. Speaker I ask you to not agree to the amendment I put on your desk information that I received from the [xx] Developers Association. The problem is the estimated by the great recession. Most of the people make inquiries to local [xx] development, groups or [xx] development groups specify that they want to see a building. If there is that building in a county they don't even go visit, if they go visit they may they're not like that building they'll build something else so they'll find out how fast they can build because our building rules are faster than some other states. I understand the amendment, this bill has been through a dozen or more drafts and I think probably in the first two, three, or four drafts it did not have buildings in it. But the reason it's in it now is because we listened to the professionals in the field, the economic developers, and they say this is what's necessary to draw people there to actually see something. It is not, let me emphasize, this program is not a grant, a tax credit, a giveaway, it is a secured loan. For what purpose does the gentleman from Nash, Representative Collins rise? If these companies are looking for buildings before they will come in my area for instance, the dozens of idle what used to be manufacturing plants and sowing plants and all these kinds of things, does this count as building that this folks will be willing to look at? I would say generally not and the reason is rehabbing old buildings, which only takes longer than building a new one and because of the recession, people they make a business decision that they want to move, but they make that decision later in the process so when they are ready to move, they want to do it a lot faster and get going. They are not willing to put up with a year of permitting and rehabbing. So I hope that answers your question push. I feel all kind of things on the floor today about this amendment let me point point out some things that I just read in the bill. It says that this provision is only going to allow show buildings if you read the bill it says new buildings renovations to buildings, and up filding buildings are part of the definition of qualified business facilities, so it just not about share building. I pulled the aspect representative Sterm, this is not a loan, this is not a subsidy, this is not grant. You were by giving 0% interest loans, no problem no return to the state 0% interest loan. Ladies and Gentlemen it's one thing to take public monies for public infrastructure, but you're going to build a bunch of buildings that businesses may not want. If a company comes into a site ready industrial area that has been provided by way of this program of public infrastructure, fine they can customize their own building. If it was even a provision here to speak about shelter buildings and have a code and code kind of model home that has one on the corner to start that's one thing, but that's is not what the bill does. The bill allows any aspect of buildings, it allows renovation of existing buildings, it creates all these aspects of proponents of this bill in regard to preserving a new building, it actually did what it said it would do, I'd be supportive of it, but it doesn't in addition it says this new building it was later added through numerous drafts this is a repeat of a bill that was done last session that Representative [xx] but actually had new buildings in it when it came to committee last session, this is not a new aspect that has been added, it is a repeat of old beams. I would ask you to support this amendment, let's get back the public infrastructure for public monies what purpose does the Gentleman from Allman Representative Rhodora. speak on the amendment Mr. Speaker. Thank you, Mr. Speaker very briefly friends this is not to gut anything this is simply designed to put some fences some boundaries in place with what we do with economic development, you think of how many dozens upon dozens of programs we have currently in place right now through out the state that are incising[sp?] economic development is quite a few out there my concern is that what we have already out there does not right now have enough transparency and accountability and metrics in place to measure their success and yet we're going to add another program, these are below market rate interest loans to localities that are going to be subsidized by everbody in North Carolina. Do we want to add another program we still leave in place the sewage, utility, signage road kind of infrastructure are not gutting the bill were simply saying the building component, the real estate component needs to stay with the locality so please urge your support for the amendment thank you. If they choose the placard they renew it every five years and at that time it requires re-certification from a physician. Well I have a 83 year old veteran of World War II and a number of other wars who is deemed and to his initial evaluations to be permanently 100% disabled and then he went to go
and get his renewal and DNB said you need to be re-certified by a physician. That was rather upsetting to him and it's just a technicality in our law that we decided in 1991 that we'd have one option for the tags not required every five years. So all this does if you're initially certified as 100% permanently disabled you do not need to go back to the doctor again and after five years and be re-certified that you're still 100% permanently disabled, I'd appreciate you support [xx] at a committee unanimous vote, thank you. It does not in any way impact the other two transportation authorities within the state, only this particular one. Few things that it does, changes the board membership to revive for two or three members of the board as voting members from the party area Board of Transportation, provides determination of a quorum the Board of Trustee to exclude vacant seats, provides the member of the board who withdraws from a meeting without being excuse shall counted as present. And these are the types of things that it changes, the administration function. The main thing it does is provides the the board shall employ a chief administrative officer, and that the board shall fix the compensation of the Chief Administative Officer, and any other employees hired by that officer, and takes that authority be away from the board, it would be run more like a city manager type of arrangement. Speaker, [xx], thank you Mr. Speaker, thank you members of the committee for allowing this bill to be heard yesterday it's a very complicated bill, so if you endorse me I will try to explain it in it best I can and in simplicity because I can house bill 437 concerns something called peretinial dialysis, so taper dialysis for patients who are undergoing something called in stage adrenal disease therapy. These patients are able to self administer the dialysis treatment and the suppliers and delivered right to the door. So that's what we're trying to address here today. The ability to self administer allows him deliver more stable life style. This bill seeks to streamline into the supply chain for the delivery these supplies to patients door. I won't go into the details of process, I'd just say there are at least four checks a long the supply chain to make sure the order is accurate and the patient is getting what they need. The most recent check was added in May of 2013 So before I get into what I'm asking to change, I want to tell you what will not change in this bill, and if you were in the health committee meeting earlier today, I apologize for hearing this again, but I feel like I need to take a minute to explain what this bill will do, and what this bill will not do. First of all, manufactures of this product maintains strict control over all products from time they're manufactured, sent to the replenishment centers for storage, delivered to the distribution centers until they're delivered to the patients, this will not change, all dialysis solutions will still be manufactured and packaged at a production facility under the supervision of the US Food and Drug Administration. Again that's not going to change, as you can see on line 17 that dialysis or drugs were lawfully held by manufacturer, or agent of the manufacturer that is properly licensed by the North Carolina department of [xx] and consumer services they'll continue to receive oversight and regulation from the department of [xx] so that provision is not going to change. So there is still going to be very tight controls through this supply chain. So now let me tell you what will change with this promising permit exemption. At the end of the process, after the patient has already received the dialysis an independent contract pharmacist is required to do a weekly retrospective inspection of what took place. To be fair, this bill does seek to exempt permitting new dialysis from the pharmacy permit mandate. Toxicologists waiting to testify when they're not needed and when we need them to do months of back up of lab work, and so what it says is because in district court, you actually have the noble right to appeal to superior court that it needs for district court purposes the prosecution may use a lab report and affidavit in lure of the toxicologist being present provided there are a number of safeguards, first if the analysis complies with other parts of the statutes, second that the analysis is part of an affidavit and the endless sign to upload, third that the district attorney gives notice to the defendant and defense attorney, and that the defense attorney then has the ability as well at that point to subpoena or issue a subpoena if they want the toxicologist present the State must comply with that subpoena and if they don't they may not admit the report and in fact their case could end up being dismissed. In addition this law should not be read as precluding any other right of the defendant in district court and finally we added in provisions that if the state is using an out of state toxicologists, the burden remains fully on the state to produce the toxicologist that they may not here's the way for procedure, if the defendant objects it all.
