There are things in place that if you need and there is anybody else to purchase from, you can sole source but this allowing him to just soe source purchases is a part for sheriffs but is not good policy. We need to look at good procurement policy and follow it in all levels state government and when you start by-passing this processes and you have another vendor that wants to do something in the sheriff's department, there is no avenue for them to be able to participate. It was vetted properly in our committees and it was vetted here on the house floor similar to the senate. As you know a lot of regulatory reforms pieces came back in different bills, in different shapes, in different forms. This information here on what was the bill center from the senate that was regarding the same issue which is in the regulatory form bill and at this time Mr. Speaker I wanted to send forth an amendment. Thank you, Mr. Speaker, the information in the amendment is that our language that was [xx] has been invaded by a number of entities and a number of our people here in the chamber to have concerns with these issues and this is what we agreed upon and any time that you're dealing with fishing [xx] to it and you can walk away at least someone happy that you done a good job as for thefor the amendment For what purpose does the lady from Gilford Representative Harrison arise? T The lady has the forward to debate the amendment Thank you Mr. Speaker ladies and gentlemen of the House I agree completely with Representative Bill when you the step onto the location versus commercial fishing, it's never a good time and always contentious, so I I just want to offer perspective that we had [xx] and arch in the [xx] committee a couple of weeks ago here in about the controversial Fishing provisions that is in place in the budget or actually Senate bill 374 and they relate to the joint force man agreement and the fore hour log, now regarding to joint the force men agreement as was explained to us, we are the only Atlantic estate that does not take advantage of that federal funding, we've lost out on $15 million so far, right now that's about $400, 000 year and what that money does is that it supplements the enforcement of our fisheries rule regulations and also this was actually performed by Federal officers right now and it seems like it makes a lot more sense to have our state enforcement officers enforcing these just it would be nice to the fishermen and most of the vote to the local fishery issues rather than have the federal police on that so we are missing on that opportunity we are missing on the federal funding I was reminded that then we heard that that dolphin killed earlier in January and February the National fisheries called the planned out where The $250, 000 so we can help deal with the stranded dolphins, dying dolphins and because we didn't have the joint enforcement agreement. They gave the $250, 000 to South Carolina which is so hard to deal with the dying dolphins so what I was explaining in this amendment is that there is something in here that we shall not ensure until joint enforcement agreement and for the reasons stated, the other thing is the issue about studying we heard about that from the head of the division in fisheries he says this issue and other issues have never been studied to death so probably come up with the same recommendation and they will be equally contentious and I think we ought to just make a decision and I appreciate the fact that the parties want to come to the table and maybe work something out but in the end I do have a problem with this continuing to refuse to enforce the joint enforcement agreement, For those reasons I would urge you to vote no. I would also say that this amendment has the support of the Recreational Fishermen Alliance of North Carolina and also the North Carolina Fisheries Association, so I would ask you to please vote for the amendment. intent of the actual bill that is currently on your Dashboard, but it actually has a study to look at this a little further. The reason why we're on this amendment is to put it back like the language of this chamber actually passed out of house bill 760. We vetted this, we talked about this, we passed this. This amendment will put it back to the House's position on this matter and actually does study it and the reason being for all that is because these measures, these two measures were put into a budget document without enough debate in regard to the constituents whether recreational charter or commercial and all we're doing is taking a step back just look at this before we actually do something and get ahead of [xx] can severely harm our constituents and potentially the fishery as well Further discussion, further debate on amendment 1 sent forward by the gentleman from Wayne. Ladies and gentlemen, this bill as currently amended as something that is very good for all of our constituents here and I just want to spell a little bit in this truth so that you can also feel good about your vote on this bill no matter how it is I would encourage you to vote for it. Let me share something with you, the aspects of the joint enforcement agreement we actually had a a good exchange recently in the NER Appropriations Committee with the Director of the Division of Marine Fisheries about this issue, and the issue is entering into an agreement with the federal government to take federal money in the strings that may be attached with that, now again if the agreement is proper and it's upheld properly we have a director that will uphold it maybe you can feel good about that but I tell you one thing my constituents made it clear to me that every time you take federal dollars there are strings attached with it, and the fear is this, is that if the federal government were actually to pass policy by the US fisher wildlife you would have state employees potentially with this joint enforcement agreement actually enforcing state, forcing federal policy that may not win through the acts of congress that would affect our constituents only aspects of teaming up with the federal government. In addition our stay is actually been a law suit before against US fisher wildlife and actually has won. Now you enter into a joining force agreement is it wise to do that? It's only a few 100000 dollars ladies and gentlemen and I think that we can actually do what's best for the management of our fisheries by actually separating the purview between the two agencies and I think this is a bad measure that needs further vetting instead of being bedded into a bunch of document. I ask you to support this measure as it's good for the fishery and for our constituents. for a purpose as the gentleman from your handover Representative Davis arise. Speak on the bill.
