In other words, this is the amendment in the eye of the insurance commissioner, as represents consumers. Consumers would under this amendment have to year by year consent to this increase in our insurance rates. this well was in the original bill, this strong language has been twiddle the way and members have I believe we need to go back to the original version, because that version,
empowered your constituents to be able to say no, to this rates as they went up year by year and allows them to say no, I would not automatically go along with this rates. Ladies and gentlemen this amendment before you has been perfect for the original language has been purposely reformed in the reason so is that the actual reason for the bill this amendment wants to go back to, is actually all knowingly harmful to the consumer, what it actually does is require, year after year after year. A wet ink signature, that is unnecessary red tape as well as, it prefers uncertainty to the consumers that they actually have to go out, and possibly resign this in regards to future CTRs that could be actually experienced cancellation. The current language in the bill has all the protections to the consumer, to where the first considerate is actually signed by a wet signature. And if there is renewal, in that renewal, that there is proper disclosure that is in front of the policy holder, to what the Mc elaborate by the insurance commissioner. As well as what they have conceded to, as well as what the increases may be, so therefore, there is no need for the wet signature as representative Ludke is trying to go back to, because the individual is consenting, once again by the way that they make the payment of the renewal, this is unnecessary regulation. There is not refer the consumer's protection action, the existing language in the bill has plenty of consumer protection, it is not weakening the aspects of the consumer but is basically eliminating unnecessary red tape, in unnecessary regulations. I would ask that you would defeat the amendment instead within the reform aspect it's a delay which is in the bill. For what purpose does the gentlemen from [xx] representative Tai rise. During her tenure in the private sector dr.combs found a three successful and took their products to worldwide distribution. This is a bill that has been thoroughly vetted, it comes from the general statute commission and has the support of the business law, section of the board and bankruptcy law section of the bar, basically a fraudulent conveyance is, when a someone who owes money to keep creditors from being collected being able to collect what's owed by the person who owes them the money, transfers property out of his/her control or ownership to someone else so that the creditors don't have assets to get paid this Bill just makes some clarifying in technical changes, maybe the chief change here is to change the title from uniform fraudulent transfer act to the uniform voidable transfer act and that can be important because many times the personal entity which has the property transferred to it is not really involved in anything long they might just gotten what they thought was a good deal on something but they might have gotten, given not reasonably equivalent value and they take except when they get a letter from a creditor or a bankruptcy trustee or receiver for someone whose asking them for the value back and they say you've done certain fraudulent. When the land is removed from the PUV program, for example soil for development, the soil the land is required to pay three years of the differed taxes at the time of sale, this bill is simply to correct the amormaly[sp?] very much over the past decade, but what if I owned property that I wanted to sale at a very low rate to a [xx] for inclusion into the neighboring state first under current law at least in some counties, you would end up even if I was trying to make a blow market sale to allow the state ultimately to acquire the land, I will end up triggering the PUV provisions and there would be taxes incurred. Normally you'd expect the county with county accessories to be all up in arms as anything. This is one of these situations where there has only been a handful of instances and it act like the county treating this sort of transaction in different ways. Today is a very important anniversary in my family Today 70 years, the Russian army, the Soviet army, liberated [xx] and on the Baltic Sea in Northern Germany, releasing my father and all of his companion in that prison of war camp, liberating them, and that's very important warned us. But that's the only favour, I might add that my father's bank mate, had stole our [xx] and was Lieutenant William Griffin, a [xx]. And they became very close friends
and Lieutenant Griffin was the only black prisoner of war in [xx]. But the Russian did us another favor. I grew up with a father who obviously suffered from PTSD even though we didn't have a name for back then, this safety depression is issues with alcohol will continuous through much altered but in 1985 the Soviet invited him to come back for a reunion at that camp because those Russian generals were aging up and they wanted to get back together, they would held a reunion, my dad did not want to go, but talking in the going, so he went back for their van and when he arrived, he run into two of the guys on the B-25 Bomber, that he was in when he was shot down of a arm that he rescued, he saved their lives, the thing that we my father suffered from was his mistreatment in that prison of war camp, but that's not what it was we didn't find the cell for many years later. My father was the last category of that aeroplane expect for the panel, the plane was shot up as it was going down, it was about a 1000 ft and they were flying country and my dad stood behind the pilot and said, aren't you going to get out of this airplane? He said, Jim, somebody is going to fly this airplane so my dad bailed out. He was immediately captured and for 40 years he believed that that power had flown that plane so he could live, that was the source of his PTST, but when he got back to the reunion, he ran to the other guys who were on the plane, and they spoke of the pilot in the present tense. And my father said, you mean he survived? And I said, yeah yeah he survived. It took down three years to find the pilot, and when he did find him the pilot said, yeah when you bailed out he said that took enough weight of the plane and I made it over that ridge we were flying towards and there was a 3000 ft valley near Arizona Italy and he said I flew as far as I could, let go the controls and I work my way out of the plain. He was later captured, but he was sent [xx] three. So, they had a good conversation and thanks to the rations that had that reunion my father PTSJ vaporized, and for last 20 years of his life, he was a different person. are able to be put together be ready for consideration for second reading on Wednesday and Thursday and probably no later than Thursday/ Friday. As you know, some of you know that are here, some of our more senior people who have put together the technical parts of the budget, people that you don't see have had a big turnover and so we all trying to be very cognizant. We are working with the central staff to make sure that we have the product when we need to have it available to the members for their consideration, but that's a general appropriations schedule for this week and for next week with the goal of being able to have our budget completed here in the house by the end of next week, and members under the number of folks will come to those, but just want to make sure members know tomorrow's plan because we heard the bills today, would appear that far as in session there would be no votes at this point at I don't want to work that down. There's a chance we may have to do a resolution concerning a joint session. And we don't know about that just yet, but that's the only thing the chair is aware of may be discussed and it's a joint session to honor Duke University on their National Championships so we're not sure if we're going to have to have a joint resolution or not. What the chair is going to do on this representative the chair is not going to instruct the subcommittee chair on how to run their committees if there were may be that the sub committee those has processes and little of no amendments it may be prepare to report the committee bill, committee report out by whatever time. I don't mind saying this here in session, what I would tell those committee chairs, if the committee chairs know of the amendments, our members it does if you're going to run the amendments to make the accommodations so the amendments can be run. That's generally a better use of time to do that in the sub-committee because if the amendments aren't heard there, one can rest assured they will probably be back in the full appropriations committee.
